KASHOPS Terms of Use
These Terms of Use (“Terms”) govern access to and use of the KASHOPS website, mobile applications, software, services and related digital platforms (collectively, the “Platform”) operated under the brand name KASHOPS, a sole proprietorship business owned by Parveena Rasool, bearing Udyam Registration Number UDYAM-JK-15-0040665. The Platform may be managed and operated on behalf of the proprietor by authorised persons (collectively, “KASHOPS”, “we”, “us” or “our”).
By accessing, registering with or using the Platform, you (“User”, “you” or “your”) acknowledge that you have read and understood these Terms and the KASHOPS Privacy Policy.
Where applicable law requires separate, express, renewed or specific consent, KASHOPS will obtain such consent through the Platform or other appropriate means.
If you do not agree to these Terms, you must not use the Platform.
1. ABOUT KASHOPS
KASHOPS is a digital marketplace, intermediary and discovery platform intended to help Users discover local shops, products and independent Sellers and communicate with Sellers and businesses.
Unless expressly stated otherwise, KASHOPS does not itself manufacture, own, sell, supply, distribute, stock, package or deliver products listed by independent Sellers.
KASHOPS currently does not itself process or collect payments for purchases made from Sellers, hold customer funds, operate an escrow or wallet, or act as the Seller or supplier of products listed by independent Sellers. If KASHOPS introduces payment processing, fund-holding, delivery, fulfilment or other transaction-related functionality in the future, the applicable terms, policies and disclosures may be updated before or when that functionality becomes available.
A transaction for goods or services may be concluded between a User and a Seller following discovery or communication through the Platform. Unless expressly stated otherwise, the Seller remains responsible for the relevant product or service and for fulfilling its legal and contractual obligations to the User.
Any purchase, sale, payment, delivery, return, replacement, refund, warranty or other transaction between a User and a Seller is subject to applicable law and the terms applicable to that transaction.
Nothing in these Terms removes or limits any obligation that applicable law directly imposes on KASHOPS.
KASHOPS may introduce additional services or functionality in the future. Where such functionality materially changes KASHOPS’s role, applicable terms, policies or disclosures may be updated accordingly.
2. DEFINITIONS
- “Seller” means an independent shopkeeper, merchant, business or other person or entity that creates, operates or manages a shop, profile or Listing on KASHOPS.
- “User” means any person accessing or using KASHOPS, including visitors, customers and registered users.
- “Content” means text, images, photographs, videos, product information, shop information, reviews, ratings, messages and other material submitted, uploaded, displayed or transmitted through the Platform.
- “Listing” means a product, service or other offering displayed by a Seller through KASHOPS.
- “Platform” means the KASHOPS website, mobile applications, software, interfaces, features and related digital services.
3. ELIGIBILITY AND AGE
You may use KASHOPS only if you are legally capable of entering into a binding agreement under applicable law.
KASHOPS may permit access to certain publicly available Platform content without registration. However, particular features, including account creation, messaging, seller interaction, transactions or other features involving personal-data processing, may be subject to age, parental-consent, verification or other eligibility requirements.
Persons under eighteen years of age may access publicly available Platform content where lawful. However, they must not independently enter into transactions, create binding contractual arrangements, make purchases, provide legally binding instructions or use restricted features unless permitted by applicable law and undertaken with the involvement, supervision or consent of a parent or lawful guardian where required.
Where applicable law requires a parent or lawful guardian to enter into, approve or supervise a transaction or arrangement, the parent or lawful guardian is responsible for undertaking or supervising that transaction or arrangement.
Where applicable law requires verifiable parental or lawful-guardian consent before processing the personal data of a child, KASHOPS will obtain such consent or restrict the relevant processing as required by law.
For purposes of applicable Indian data-protection law, a child is generally a person who has not completed eighteen years of age.
KASHOPS may impose additional age, identity or eligibility requirements for particular features, services or product categories where reasonably necessary or required by law.
4. ACCOUNT REGISTRATION
Certain features of KASHOPS may require registration or an account.
You agree to:
- provide accurate, complete and non-misleading information;
- keep information reasonably current where necessary;
- maintain the confidentiality of your account credentials;
- not impersonate another person or entity;
- not create accounts for fraudulent, unlawful or abusive purposes;
- not create or operate accounts on behalf of another person without appropriate authority; and
- promptly notify KASHOPS if you reasonably suspect unauthorised access to your account.
You are responsible for activity occurring through your account, subject to applicable law and circumstances beyond your reasonable control.
KASHOPS may require verification information where reasonably necessary for security, fraud prevention, legal compliance, Seller verification, dispute handling or operation of the Platform.
5. KASHOPS’S ROLE
KASHOPS provides technology and marketplace functionality through which Users may discover Sellers, Listings and local businesses and communicate with Sellers.
KASHOPS acts as a marketplace and intermediary technology platform facilitating discovery, publication of Listings and communication between Users and independent Sellers. KASHOPS does not ordinarily take ownership, possession or control of Seller inventory or the goods and services offered by Sellers.
Depending on the nature and functionality of the Platform, KASHOPS may qualify as an intermediary and/or marketplace e-commerce entity under applicable Indian law. KASHOPS intends to rely on protections available to intermediaries only to the extent that the statutory requirements for those protections are satisfied. KASHOPS will comply with legal obligations applicable to its role.
KASHOPS does not ordinarily act as the Seller, manufacturer, distributor, agent or representative of a Seller merely because a Seller uses the Platform.
Information concerning products and Sellers, including descriptions, prices, availability, specifications, warranties, quality, authenticity, origin and other characteristics, is generally supplied by Sellers.
The presence of a Listing on KASHOPS does not by itself constitute a representation or guarantee by KASHOPS that the Listing, Seller or product is lawful, authentic, safe, suitable, available or accurate.
KASHOPS may provide tools to assist Sellers in publishing information and Users in discovering or communicating with Sellers. Such tools do not, by themselves, make KASHOPS the manufacturer, Seller or supplier of the relevant product.
Nothing in this section excludes, restricts or limits any responsibility or liability that KASHOPS cannot lawfully exclude, restrict or limit.
6. DEALINGS BETWEEN USERS AND SELLERS
Users should exercise reasonable caution and conduct appropriate due diligence before entering into a transaction or other arrangement with a Seller.
Where a User and Seller enter into a transaction or arrangement through or following communication on KASHOPS, the relevant parties are responsible for complying with applicable laws and the terms applicable to that transaction.
KASHOPS does not currently collect purchase consideration from Users on behalf of Sellers, receive or hold customer money, operate an escrow or wallet, or otherwise control transaction funds. If KASHOPS introduces any payment, fund-holding or transaction-processing functionality in the future, the applicable terms and disclosures will be updated accordingly.
Unless expressly stated otherwise, KASHOPS does not take ownership of Seller inventory and does not manufacture, package, stock, store, dispatch or deliver Seller products.
Unless expressly stated otherwise, KASHOPS does not guarantee that a Seller will:
- respond to an enquiry;
- accept an offer;
- reserve or hold a product;
- maintain availability;
- provide a particular price;
- complete a transaction; or
- provide any particular after-sales service.
The Seller remains responsible for fulfilling its legal and contractual obligations, including obligations relating to product quality, authenticity, safety, delivery, returns, refunds, replacements, warranties, consumer protection and applicable taxes.
Any statutory rights that Users or consumers have against Sellers remain unaffected.
7. SELLER INFORMATION AND LISTINGS
Sellers are responsible for ensuring that information supplied to KASHOPS is accurate, complete, current and lawful.
Sellers must comply with applicable law, the KASHOPS Seller Agreement and applicable Seller policies.
Depending on the nature of the Seller and Listing, KASHOPS may require information including:
- Seller or business identification information;
- business or shop name;
- principal geographic or business address where required;
- customer-care contact information;
- applicable registration or licence information;
- GST registration status and GSTIN, where applicable;
- PAN or other legally required information;
- product name and description;
- applicable price and charges;
- availability;
- applicable taxes;
- relevant product characteristics;
- country of origin where required;
- manufacturer, importer, packer or other responsible-party information where applicable;
- return, refund, cancellation, replacement or warranty information;
- grievance-officer information where required; and
- other information required by applicable law.
Sellers must not provide materially false, misleading or deceptive information.
Sellers must ensure that descriptions, images and other Content relating to their goods or services accurately correspond with the goods or services offered.
Sellers must clearly disclose applicable charges, taxes, delivery terms, cancellation terms, return and refund conditions, warranty or guarantee information and other material terms required by applicable law.
KASHOPS may display information supplied by Sellers, including product names, descriptions, prices, images, availability, shop information and business information.
KASHOPS may correct formatting, resize, compress, optimise, categorise or technically process Content for Platform functionality. Such technical processing does not make KASHOPS the creator or owner of Seller Content.
KASHOPS may require Sellers to update, correct or supplement information where reasonably necessary for legal compliance, consumer protection, Platform safety or accuracy.
8. SELLER COMPLIANCE AND RESPONSIBILITIES
Sellers must comply with applicable laws, regulations, licences, registrations, industry requirements, the KASHOPS Seller Agreement, Seller Policy, Seller Standards and other applicable Platform policies.
Sellers are responsible for ensuring that all products and services offered through KASHOPS are lawful, authentic, safe, accurately described and permitted to be offered through the Platform.
Sellers must not:
- offer counterfeit, stolen, unsafe, prohibited or unlawful products or services;
- make false, misleading, deceptive or unsubstantiated claims;
- infringe intellectual-property, privacy, publicity or other rights;
- conceal material charges, taxes, restrictions or transaction terms;
- manipulate reviews, ratings or other Platform information;
- evade applicable GST, tax, licensing, registration or reporting obligations; or
- use KASHOPS to facilitate fraud, scams or other unlawful conduct.
Sellers are responsible for:
- the legality and authenticity of their products and services;
- the accuracy of their Listings;
- complying with applicable product, consumer, tax, licensing and advertising requirements;
- maintaining applicable GST, PAN, registration, licence and other legally required information;
- honouring applicable prices and terms displayed to consumers;
- complying with applicable return, refund, replacement, cancellation and warranty obligations;
- complying with applicable delivery or fulfilment commitments;
- responding to consumer grievances;
- providing information required by law;
- cooperating with reasonable investigations, complaints and enforcement processes;
- complying with intellectual-property requirements; and
- complying with the KASHOPS Seller Agreement and Seller policies.
Sellers acknowledge that use of KASHOPS may also be subject to a separate KASHOPS Seller Agreement, Seller Policy, Seller Standards, Prohibited Products Policy and other applicable documents. In the event of a conflict, the applicable Seller Agreement will govern the Seller relationship to the extent expressly stated in that agreement and subject to applicable law.
Nothing in these Terms prevents a User or consumer from exercising rights available against a Seller under applicable law.
9. PROHIBITED CONDUCT
Users must not use KASHOPS to:
- violate applicable law or regulation;
- facilitate, promote or participate in unlawful activity;
- upload, publish or distribute fraudulent, deceptive, defamatory or otherwise unlawful material;
- sell, offer, advertise or promote products or services prohibited under KASHOPS policies or applicable law;
- infringe intellectual-property, privacy, publicity or other rights of another person;
- impersonate another person or business;
- conduct scams, fraud, cheating or deceptive schemes;
- harass, threaten, abuse, intimidate or unlawfully target another person;
- upload malware, malicious code or other harmful software;
- interfere with Platform security or operation;
- scrape, crawl or systematically extract Platform data without authorisation;
- manipulate reviews, ratings, rankings or Platform information;
- circumvent authentication, security or access controls;
- create misleading or fraudulent shops, accounts or Listings;
- send spam or unauthorised commercial communications;
- misuse another person’s personal information;
- circumvent restrictions, suspensions or enforcement measures imposed by KASHOPS;
- use deceptive interface practices, hidden charges or other manipulative mechanisms intended to mislead Users; or
- otherwise misuse the Platform.
KASHOPS may take appropriate action where it reasonably believes that prohibited conduct has occurred or may create a legal, safety, security or operational risk.
10. USER CONTENT
You retain ownership of Content that you lawfully own.
By submitting Content to KASHOPS, you grant KASHOPS a non-exclusive, worldwide, royalty-free licence, for the period reasonably necessary to operate the Platform and fulfil the purposes for which the Content was submitted, to host, store, reproduce, display, communicate, format, adapt and technically process that Content.
This licence is limited to purposes reasonably connected with operating, maintaining, securing, improving and providing the Platform and related services, subject to the KASHOPS Privacy Policy and applicable law.
You represent and warrant that you have the necessary rights, permissions and authority to submit the Content and grant the rights described above.
KASHOPS may remove, restrict or disable access to Content where reasonably necessary for:
- compliance with applicable law;
- Platform safety or security;
- enforcement of these Terms or applicable policies;
- intellectual-property concerns;
- prevention of fraud or abuse;
- content that is fraudulent, defamatory, unlawful, misleading, abusive, harassing, infringing, manipulated or fake; or
- other legitimate Platform purposes.
Nothing in this section transfers ownership of your Content to KASHOPS.
11. REVIEWS AND RATINGS
Where KASHOPS permits reviews, ratings or feedback, Users must provide genuine and reasonably accurate opinions based on their actual experience.
Users must not:
- submit fabricated or materially misleading reviews;
- review a transaction or experience they did not actually have;
- manipulate ratings or review systems;
- offer or request compensation in exchange for false or misleading reviews;
- threaten, harass or extort another person through reviews; or
- use reviews for fraudulent or unlawful purposes.
KASHOPS may remove, restrict or decline to display reviews that are fraudulent, defamatory, unlawful, misleading, abusive, harassing, infringing, manipulated, fake or otherwise prohibited by law, these Terms or applicable Platform policies.
KASHOPS may use reasonable technical or administrative measures to detect or prevent review manipulation.
12. CONSUMER PROTECTION AND E-COMMERCE COMPLIANCE
Where the Consumer Protection (E-Commerce) Rules, 2020 or other applicable consumer-protection law applies to KASHOPS, KASHOPS will comply with obligations applicable to its role as an e-commerce entity and/or marketplace e-commerce entity.
KASHOPS may provide Users with information necessary to make informed decisions before engaging with Sellers, including, where applicable:
- Seller identity and business information;
- Seller contact details;
- applicable Seller ratings or aggregated feedback;
- product and Listing information;
- price and applicable charges;
- taxes and other mandatory charges;
- delivery or shipment information;
- return, refund, exchange, cancellation and warranty information;
- applicable payment information;
- grievance mechanisms; and
- other information required by applicable law.
KASHOPS will not knowingly engage in unfair trade practices prohibited by applicable consumer-protection law.
Where a statutory requirement applies to consumer consent, KASHOPS will obtain such consent through an explicit and affirmative action and will not rely upon pre-selected or pre-ticked consent mechanisms where prohibited.
Where applicable law requires complaint tracking, KASHOPS may provide a complaint or ticket reference through which the User can monitor the status of the complaint.
Nothing in this section limits any statutory rights or remedies available to consumers.
13. REPORTING, GRIEVANCES AND MODERATION
Users may report Listings, Sellers, accounts, messages or other Content through mechanisms provided by KASHOPS.
KASHOPS will maintain grievance and reporting mechanisms appropriate to its legal obligations and the nature of the Platform.
The Grievance Officer is designated separately from the proprietor and is responsible for receiving and coordinating applicable grievances in accordance with law and KASHOPS procedures.
Where KASHOPS is subject to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended from time to time, it will maintain the grievance mechanism and timelines applicable to intermediaries.
Where applicable, the Grievance Officer will acknowledge complaints within the period prescribed by law and will resolve them within the applicable statutory period.
For intermediary grievances, KASHOPS will follow the timelines prescribed by the applicable IT Rules, including any applicable acknowledgement, resolution, removal or disabling-access timelines. KASHOPS will not apply one generic deadline to all complaints where different statutory timelines apply.
For complaints concerning specific categories of content or requests made by authorised government agencies or courts, KASHOPS will follow the applicable shorter or special statutory timeline.
For consumer complaints governed by the Consumer Protection (E-Commerce) Rules, 2020, KASHOPS will follow the applicable consumer-grievance requirements and timelines.
KASHOPS may investigate reports and take appropriate action, including:
- removing or restricting Content;
- disabling or restricting Listings;
- suspending or terminating accounts;
- restricting Platform functionality;
- requesting additional information or verification;
- preserving relevant records where legally permitted or required; or
- referring matters to appropriate authorities where required or reasonably appropriate.
KASHOPS does not guarantee that every report will result in removal, suspension or other enforcement action.
Information concerning the Grievance Officer and the applicable grievance mechanism will be prominently published on the Platform.
14. INTELLECTUAL PROPERTY
The KASHOPS name, logo, branding, software, interface, design, original text, graphics and other Platform materials owned or lawfully used by KASHOPS are protected by applicable intellectual-property laws.
Except as expressly permitted by KASHOPS or applicable law, Users must not:
- reproduce;
- modify;
- distribute;
- sell;
- license;
- commercially exploit;
- reverse engineer; or
- otherwise misuse
KASHOPS intellectual property or Platform materials.
Third-party trademarks, logos, product names and other intellectual property remain the property of their respective owners.
Nothing in these Terms transfers ownership of KASHOPS intellectual property to any User.
15. PRIVACY AND PERSONAL DATA
KASHOPS processes personal data in accordance with its separate KASHOPS Privacy Policy and applicable Indian data-protection and privacy laws.
The KASHOPS Privacy Policy explains, among other matters:
- the categories of personal data KASHOPS may process;
- the purposes of processing;
- applicable consent requirements;
- user rights and available request mechanisms;
- children’s personal data;
- retention and deletion practices;
- security safeguards;
- grievance and privacy complaint mechanisms;
- personal-data breach handling and notifications; and
- requirements applicable under the Digital Personal Data Protection Act, 2023 and related rules when legally applicable and effective.
KASHOPS may act as a Data Fiduciary under the Digital Personal Data Protection Act, 2023 where it determines the purpose and means of processing digital personal data.
The Privacy Policy forms part of these Terms by reference.
KASHOPS will implement applicable requirements under the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025 when and to the extent those provisions are legally applicable and effective.
Where applicable law requires consent, notice, withdrawal mechanisms, rights handling, security safeguards, breach notification, children’s-data protections or other specific measures, KASHOPS will implement those requirements in accordance with the applicable legal framework and its effective commencement.
Where consent is the applicable legal basis for processing, KASHOPS will obtain consent through an appropriate clear affirmative action and will provide a mechanism for withdrawal of consent as required by applicable law.
16. CHILDREN AND PERSONAL DATA
KASHOPS recognises that Indian data-protection law provides additional protections for children.
Where applicable law requires verifiable consent of a parent or lawful guardian before processing a child’s personal data, KASHOPS will obtain such consent in the manner required by applicable law.
KASHOPS will not knowingly undertake processing of children’s personal data that is prohibited by applicable law, including prohibited tracking, behavioural monitoring or targeted advertising directed at children.
KASHOPS may restrict account registration, messaging, personalised features or other functionality for persons below eighteen years of age where reasonably necessary to comply with applicable law or protect Users.
Nothing in this section prevents access to publicly available information where such access is lawful and does not involve prohibited processing of children’s personal data.
17. PLATFORM AVAILABILITY AND CHANGES
KASHOPS may modify, suspend, restrict or discontinue any part of the Platform, temporarily or permanently, including particular features or functionality.
KASHOPS does not guarantee that the Platform will always be uninterrupted, error-free, secure or continuously available.
Maintenance, technical failures, security incidents, third-party dependencies, events beyond reasonable control or legal requirements may affect Platform availability.
Nothing in this section excludes or limits any rights or remedies that cannot lawfully be excluded or limited.
18. SUSPENSION AND TERMINATION
KASHOPS may suspend, restrict or terminate an account, Listing or Platform functionality where reasonably necessary, including where:
- these Terms or applicable policies have been violated;
- applicable law or a lawful authority requires action;
- fraudulent, abusive or unlawful activity is suspected;
- Platform or account security is threatened;
- continued activity creates a material risk to Users, Sellers or KASHOPS;
- information provided is materially false or misleading;
- a Seller fails to satisfy applicable verification or compliance requirements; or
- continued access may expose KASHOPS or others to material legal, security or operational risk.
Where reasonably practicable and legally permissible, KASHOPS may provide notice or an opportunity to address the relevant issue.
KASHOPS may take immediate action where delay could create legal, security, fraud, safety or other material risk.
Where appropriate and legally permissible, Users or Sellers may request review or appeal of an enforcement decision through mechanisms provided by KASHOPS.
Termination or suspension does not affect rights or obligations that accrued before termination or that by their nature should survive termination.
19. DISCLAIMERS
To the maximum extent permitted by applicable law, KASHOPS does not warrant or guarantee that:
- Listings will always be accurate or complete;
- Seller information will always be accurate or current;
- Sellers will be suitable for a particular User;
- products will be authentic, safe, lawful or available;
- Sellers will complete transactions;
- User or Seller communications will always be accurate or reliable;
- the Platform will always be uninterrupted or error-free; or
- information supplied by third parties will always be complete or accurate.
KASHOPS is a technology and marketplace/discovery platform connecting Users with independent Sellers.
KASHOPS does not, merely by providing the Platform, become the manufacturer, Seller, supplier, distributor, agent or guarantor of a Seller or its products.
These disclaimers do not exclude any responsibility imposed directly on KASHOPS by applicable law, including statutory, consumer-protection, intermediary, grievance-redressal, privacy or data-protection obligations.
KASHOPS is not responsible for a Seller’s independent acts or omissions except to the extent that applicable law imposes responsibility on KASHOPS or the matter arises from KASHOPS’s own breach, negligence, unlawful conduct or non-compliance with a non-excludable obligation.
20. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, KASHOPS will not be liable for losses arising solely from the independent acts, omissions, representations, products, services or transactions of Users or Sellers where KASHOPS is not legally responsible for those matters.
Responsibility for a Seller’s products, product quality, authenticity, description, pricing, availability, delivery, returns, refunds, replacement, warranty and after-sales obligations rests with the Seller, subject to applicable law.
Where a User or Seller commits fraud, cheating, misrepresentation, scam or other unlawful conduct, responsibility for that conduct rests with the person responsible, subject to applicable law.
KASHOPS is not ordinarily a party to, and does not guarantee, insure or underwrite, a transaction between a User and Seller merely because the transaction was discovered, discussed or arranged through the Platform.
Nothing in these Terms limits liability or responsibility that applicable law directly places on KASHOPS, including applicable statutory, consumer-protection, intermediary, grievance-redressal, privacy or data-protection obligations.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, unlawful conduct, gross negligence or any other matter for which liability cannot lawfully be excluded or limited.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
21. INDEMNIFICATION
To the extent permitted by applicable law, a User agrees to indemnify and hold harmless KASHOPS and its officers, employees and authorised representatives from third-party claims, losses, liabilities and reasonable expenses arising directly from:
- the User’s unlawful use of the Platform;
- the User’s material breach of these Terms;
- infringement of a third party’s intellectual-property or other legal rights by the User;
- fraudulent or intentionally wrongful conduct by the User; or
- Content submitted by the User that unlawfully infringes the rights of another person.
To the extent permitted by applicable law, a Seller agrees to indemnify and hold harmless KASHOPS and its officers, employees and authorised representatives from third-party claims, losses, liabilities, penalties, regulatory actions and reasonable expenses arising directly from:
- illegal, prohibited, unsafe, counterfeit or unauthorised products or services offered by the Seller;
- inaccurate, misleading or deceptive Listings or Seller information;
- infringement of intellectual-property, privacy, publicity or other rights;
- violation of applicable consumer-protection, e-commerce, tax, licensing, product-safety or advertising requirements;
- failure to honour applicable return, refund, cancellation, replacement, warranty, delivery or fulfilment obligations;
- consumer claims caused by the Seller’s products, services, conduct or omissions;
- disputes between the Seller and a User arising from the Seller’s products or services;
- regulatory violations or enforcement actions caused by the Seller; or
- the Seller’s material breach of the KASHOPS Seller Agreement, these Terms or applicable Platform policies.
These provisions are subject to applicable law and do not require a User or Seller to indemnify KASHOPS for KASHOPS’s own non-excludable liability, unlawful conduct, fraud, wilful misconduct or other liability that cannot lawfully be transferred.
22. CHANGES TO THESE TERMS
KASHOPS may update these Terms from time to time.
Where changes are material, KASHOPS may communicate them through reasonable means appropriate to the circumstances and as required by applicable law.
The updated Terms will state the applicable effective date.
Continued use of the Platform after the effective date of updated Terms will constitute acceptance only to the extent legally sufficient.
Where applicable law requires renewed or express consent, KASHOPS will obtain such consent before or as a condition of continued use, as required.
23. DISPUTE RESOLUTION, GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of India, subject to applicable mandatory statutory rights and protections.
23.1 Seller Disputes
Disputes between KASHOPS and Sellers arising from the Seller relationship may first be addressed through good-faith discussions.
Where the Seller Agreement provides for arbitration, disputes may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time, and the applicable provisions of the Seller Agreement.
The Seller Agreement will specify the applicable seat, venue, language and appointment mechanism where arbitration is adopted.
23.2 Consumer and User Disputes
Nothing in these Terms requires a consumer or User to waive or surrender a mandatory statutory right or remedy.
Consumers may use applicable grievance mechanisms and may approach a competent consumer commission, court or other forum having jurisdiction under applicable law.
23.3 Grievance Redressal
Users and consumers may submit grievances through the KASHOPS grievance mechanism and designated Grievance Officer:

KASHOPS will handle grievances in accordance with applicable law and applicable timelines.
23.4 Courts and Competent Forums
Subject to mandatory statutory rights, applicable jurisdictional rules and any valid arbitration agreement, disputes may be brought before the courts or competent forums having jurisdiction under applicable law.
23.5 Preservation of Consumer Rights
Nothing in these Terms is intended to exclude, restrict or waive any consumer right or statutory remedy that cannot lawfully be excluded, restricted or waived.
24. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be modified or interpreted to the minimum extent necessary to make it enforceable where legally permissible.
The remaining provisions will continue in effect to the extent permitted by applicable law.
25. ENTIRE AGREEMENT
These Terms, together with documents and policies expressly incorporated by reference, including the KASHOPS Privacy Policy, Seller Agreement, Seller Policy, Seller Standards, Grievance and Complaints Policy, Prohibited Products Policy and any applicable Returns and Refunds Policy, constitute the agreement between the relevant User and KASHOPS concerning use of the Platform, subject to applicable law.
If there is a conflict between these Terms and a mandatory statutory provision, the statutory provision will prevail to the extent of the conflict.
Where a User or Seller enters into a separate agreement with KASHOPS for a particular service, the terms of that agreement will apply to the extent expressly stated in that agreement.
