KASHOPS Prohibited Products & Activities Policy

1. GENERAL RULE

A Seller may list only products and services that:

• are lawful to sell or provide in India;
• the Seller is legally authorised to sell or provide;
• comply with applicable licensing, regulatory, safety, consumer-protection and other legal requirements;
• are accurately described and represented;
• do not infringe third-party rights; and
• comply with KASHOPS policies and requirements.

The absence of a product, service or activity from a specific example in this Policy does not mean that it is permitted.

KASHOPS may prohibit or restrict a product, service, content or activity where its sale, possession, advertising, distribution or use is unlawful, or where KASHOPS reasonably determines that permitting it would create unacceptable legal, safety, consumer-protection, fraud, operational or Platform risks.

2. ILLEGAL GOODS

KASHOPS prohibits goods whose sale, possession, distribution, advertising or other dealing is prohibited under applicable law.

3. STOLEN PROPERTY

Listings for stolen property, unlawfully obtained goods, or property that the Seller does not have the lawful right or authority to sell are prohibited.

4. COUNTERFEIT AND INFRINGING GOODS

Prohibited products and listings include:

• counterfeit goods;
• unauthorised replicas represented as genuine;
• goods bearing trademarks without appropriate authorisation;
• pirated goods;
• infringing copies;
• products using protected images, designs or other intellectual property without appropriate rights; and
• goods or listings otherwise infringing third-party intellectual-property rights.

5. WEAPONS AND DANGEROUS ITEMS

Weapons, ammunition, explosives and other dangerous or regulated items may not be listed unless KASHOPS expressly permits the relevant category following appropriate legal and safety review and the Seller can demonstrate all required licences, approvals and compliance.

KASHOPS may prohibit or restrict categories even where a particular item may technically be lawful in certain circumstances.

6. NARCOTIC, CONTROLLED AND ILLEGAL SUBSTANCES

Illegal drugs, narcotic substances and other prohibited controlled substances may not be listed.

Products whose sale, possession or distribution requires special regulatory authorisation may be restricted or prohibited unless KASHOPS has expressly approved the relevant category and the Seller satisfies all applicable requirements.

7. MEDICINES AND MEDICAL PRODUCTS

Medicines, prescription products, medical devices and other regulated healthcare products may be restricted or prohibited.

A Seller must not list regulated healthcare products unless legally authorised and compliant with all applicable laws, licences, registrations, standards and other requirements.

KASHOPS may prohibit specific healthcare categories regardless of whether a Seller claims to possess a licence or authorisation.

8. ALCOHOL, TOBACCO AND AGE-RESTRICTED PRODUCTS

Products subject to age restrictions, licensing requirements, taxation requirements or state-specific restrictions may be prohibited or restricted.

KASHOPS may impose stricter Platform restrictions than the minimum required by applicable law.

9. FOOD AND CONSUMABLE PRODUCTS

Food and other consumable products must comply with applicable food-safety, labelling, packaging, licensing, registration and other legal requirements.

KASHOPS may require relevant licences, registrations, certifications or mandatory product information before permitting such Listings.

10. HAZARDOUS MATERIALS

Products that present significant chemical, biological, fire, environmental, transportation or other safety risks may be prohibited or restricted.

11. FRAUDULENT DOCUMENTS AND SERVICES

KASHOPS prohibits listings involving:

• forged or fraudulent documents;
• fake certificates;
• fake identity documents;
• fake educational credentials;
• unlawful government documents;
• fraudulent financial instruments; or
• services intended to facilitate fraud, deception or unlawful misrepresentation.

12. ILLEGAL SERVICES

Services intended to facilitate criminal activity, fraud, harassment, exploitation or other unlawful conduct are prohibited.

13. SEXUAL EXPLOITATION AND ABUSE

Content, products or activities involving child sexual exploitation, sexual abuse, trafficking or other unlawful exploitation are strictly prohibited.

KASHOPS may take appropriate action and may report suspected unlawful conduct to relevant authorities where required or appropriate.

14. HATEFUL, THREATENING OR ABUSIVE CONTENT

KASHOPS prohibits content or activities that violate applicable law or are used to threaten, harass, intimidate, abuse or unlawfully target individuals or groups.

15. GAMBLING AND UNLAWFUL FINANCIAL ACTIVITIES

Unlawful gambling, fraudulent investment schemes, unauthorised financial services and similar unlawful activities are prohibited.

16. PERSONAL DATA AND PRIVACY VIOLATIONS

Sellers must not list, publish, disclose or distribute another person’s personal information without lawful authority.

Users and Sellers must not use KASHOPS to collect, publish, disclose, misuse or otherwise process personal information for unlawful purposes.

17. MISLEADING LISTINGS

Prohibited conduct includes:

• false or materially misleading product claims;
• misleading prices;
• fake discounts;
• fabricated scarcity or urgency;
• false or manipulated reviews;
• false business identities;
• deceptive product images; and
• materially misleading product or service descriptions.

KASHOPS’s Platform and marketplace practices should also be operated consistently with applicable consumer-protection requirements concerning deceptive design, unfair trade practices and other prohibited or misleading practices.

18. INTELLECTUAL-PROPERTY-INFRINGING CONTENT

Sellers must not upload, publish or use Content that they do not have the lawful right or permission to use.

KASHOPS may remove, restrict or disable access to Content following a credible intellectual-property complaint, where infringement is reasonably identified, or where otherwise required by applicable law.

19. CIRCUMVENTION AND FRAUD

Users and Sellers must not use KASHOPS to facilitate or engage in:

• scams or fraudulent schemes;
• phishing;
• impersonation;
• fake shops or business identities;
• fraudulent transactions;
• account manipulation;
• artificial or manipulated reviews;
• Platform abuse; or
• attempts to circumvent KASHOPS policies, safeguards or enforcement measures.

A Seller may be held responsible for fraud, cheating, scams, misrepresentation or other unlawful conduct attributable to that Seller, in accordance with the KASHOPS Seller Agreement and applicable law.

20. RESTRICTED CATEGORIES

KASHOPS may designate certain categories as restricted and require additional:

• Seller verification;
• documentation;
• licences or registrations;
• age checks;
• Seller information;
• product information; or
• prior Platform approval.

KASHOPS may suspend, restrict or discontinue a category at any time where reasonably necessary for legal, safety, consumer-protection, fraud-prevention or operational reasons.

21. REPORTING

Users and Sellers may report suspected violations through the available KASHOPS reporting mechanisms, including:

KASHOPS may provide additional reporting methods or channels from time to time.

Reports should include sufficient information to allow KASHOPS to understand and investigate the suspected violation.

22. ENFORCEMENT

Where KASHOPS reasonably identifies a violation of this Policy, applicable law or another KASHOPS policy, it may take appropriate action, including:

• removing or disabling a Listing;
• restricting Listing or Shop visibility;
• requesting additional information or documentation;
• restricting Platform functionality;
• suspending a Seller or User account;
• terminating an account or Platform access;
• preserving relevant information where legally appropriate; or
• referring a matter to appropriate authorities where required or appropriate.

KASHOPS may take immediate action where reasonably necessary to protect Users or Sellers, comply with applicable law, prevent serious harm, address fraud or abuse, or protect the integrity and safety of the Platform.

Enforcement action may be taken in addition to, and without prejudice to, any other rights or remedies available under the KASHOPS Seller Agreement, Terms of Use or applicable law.

23. POLICY UPDATES

KASHOPS may update this Policy from time to time to reflect changes in law, regulatory guidance, Platform development, safety requirements, consumer-protection requirements or newly identified risks.

Sellers and Users are responsible for complying with the current version of this Policy applicable to their use of KASHOPS and their Listings or activities.

The latest version will be made available through the Platform or other appropriate means.
